What is Build America Buy America?
The Build America, Buy America Act (BABA), was enacted as part of the Infrastructure Investment and Jobs Act on November 15, 2021. It focuses on increasing the federal government’s use of American-made goods, materials, and services. This policy mandates that all iron, steel, manufactured products, and construction materials used in federally funded infrastructure projects be produced domestically.
To ensure that recipients of federal financial assistance comply with BABA, agencies such as the USDA have collaborated with the Office of Management and Budget (OMB) and the Made in America Office. Since May 14, 2022, agencies and staff offices have had to incorporate BABA preferences into the terms and conditions of USDA Financial Assistance awards.

What Is Considered Compliant With Build America Buy America?
Under Build America Buy America, compliance means using iron, steel, manufactured products, and construction materials that are domestically produced. This applies to every permanently installed item on federally funded infrastructure projects, with the exception of aggregate and aggregate binding materials.

What Type Of Certification Is Required To Show Proof?

This documentation should identify the product and certify its compliance with BABA standards. It must be signed by an authorized representative of the manufacturing company.

Recipients (Project Owners)
Ultimately, the project owner or recipient of federal assistance is responsible for maintaining compliance with the Build America Buy America Act. These records may be necessary should the project undergo an audit.
Manufacturers
Manufacturers must provide a certification letter or other compliance documents for every applicable product. The documentation should include a brief description of the item, its part number, if applicable, and a statement confirming that the item adheres to BABA standards. This helps ensure transparency and accountability throughout the supply chain.
Architects and Engineers
Architects and engineers are required to gather and maintain all related documentation (especially manufacturers’ certifications) during the construction process and eventually pass these records along to the project owner.
Resident Project Representative/Resident Inspectors
The Resident Project Representative or Resident Inspector’s duties include verifying that items delivered to the project site come with the necessary BABA compliance documentation. They are encouraged to document deliveries and maintain daily logs, which become part of the permanent record for the project. This additional oversight helps catch discrepancies early on and prevents non-compliant materials from being installed.

Contractors have a responsibility to ensure that construction contracts include provisions for Build America Buy America compliance. They should only be installing materials that meet these standards or have an approved waiver. Before requesting reimbursement, contractors are required to provide all relevant BABA certifications.
